According to the "National Holidays and Memorial Day Holiday Arrangement":
Holidays for all citizens are:
1. New Year's Day, 1 day off (January 1);
2. Spring Festival, 4 days off (Chinese Lunar New Year's Eve, the first three days of the first lunar month);
3. Qingming Festival, 1 day off (the day of Qingming according to the lunar calendar);
4. Labor Day, 2 days off (May 1 and 2);
5. Dragon Boat Festival, 1 day off (the day of Dragon Boat Festival according to the lunar calendar);
6. Mid-Autumn Festival, 1 day off (the day of Mid-Autumn Festival according to the lunar calendar);
7. National Day, 3 days off (October 1 to 3). If these days fall on a Saturday or Sunday, make-up days off should be arranged on working days.
For holidays observed by all citizens, reasonable arrangements for unified holidays and leave adjustments can be made, in conjunction with the implementation of paid annual leave and other systems, to effectively form longer holidays. Except under special circumstances, the continuous working period before and after statutory holidays generally does not exceed six days.
According to the law, employees usually work eight hours a day and 40 hours a week. Overtime refers to hours worked outside of those 40 hours or hours worked on Statutory Holidays. Employers may not force employees to work overtime.
1. Overtime payment. If for any reason employees work overtime, the employer shall compensate the employees as follows:
On workdays, the payment is 1.5 times regular salary;
On weekends, the payment is 2 times regular salary;
On statutory holidays, the payment is 3 times regular salary.
In China,statutory holiday means public holiday which is stipulated by the law, including: New Year's Day (one day), Chinese New Year's Day (four days), Tomb-Sweeping Day(one day), Labor Day (two day), Dragon Boat Festival(one day), Mid-Autumn Festival (one day), and National Day (three days). There are 13 days in total since 2025. The central government usually will release the exact arrangement of the statutory holiday of coming year by the end of the previous year.
2. Overtime during Statutory holidays. For overtime during weekends or workdays, the employer could allow employees to take leave which is equal to the time they worked overtime (Comp Time); however, for overtime during statutory holidays, the employer has to pay the employee three times their regular payment.
3. How to calculate overtime payment. Firstly, we have to figure out how to calculate payment for each day, which is monthly payment divided by 21.75. Suppose Alex's salary is 5000RMB, so his salary for each day is 5000/21.75=229.88RMB,If he worked overtime on Monday for two hours, then his overtime payment is 2*1.5*5000/21.75/8=86.20RMB;If he worked overtime on Saturday for two hours, then his overtime payment is 2*2*5000/21.75/8=114.94RMB,If he worked overtime for a full day on Labor Day, then his overtime payment is 3*5000/21.75=689.65RMB.Hope it is clear now.
