How To Get Married In China?

CHINA LAW 101

Two foreigners can no longer get married in China since 2019, so if both of you are foreigners, go get physically married in Hong Kong or register online in the state of Utah instead. Therefore, we mainly talk about marriages between a foreigner and a Chinese person in this video. To start with, the easiest way is to jointly apply for marriage registration at the bureau where the Chinese citizen's household registration is located.

Upon receiving a marriage registration application, the civil affairs department conducts a thorough verification process. They ensure that both parties have reached the legal minimum age for marriage—22 years for men and 20 years for women. Additionally, they check whether both individuals are single or otherwise legally free to marry. Those who have been previously married are required to provide a divorce certificate or a death certificate of the former spouse, ensuring these documents are either notarized or apostatized copies.

The documentation required from Chinese citizens includes a personal household registration certificate, which includes their ID card, and a certification from a relevant authority affirming their personal details and marital status. For foreign nationals, the necessary documents include a passport or other relevant identity documents, a residence permit if applicable, and a marital status certification from their home country's foreign affairs department.

If you would like to apply for a marriage residence permit, you will need to submit additional documents. This includes the ID and household registration of your wife, the marriage certificate, passport, and your entry visa if you are already in China. If you did not get married in China, a notarized or apostatized copy of the marriage certificate will be needed, depending on whether or not that country has signed the Hague Convention. Please note very carefully that you cannot work under a marriage residence permit or a reunion visa as some people call it. If you want to work in China, you must apply for a work permit instead.
