Exciting news—holidays are just around the corner!


Mid-Autumn Festival


From September 15th to September 17th, you will enjoy a three-day break for the Mid-Autumn Festival. However, to accommodate this, September 14th (Saturday) will be a working day.


National Day Holiday


For National Day, there will be a longer break from October 1st to October 7th, totaling seven days. To make up for this extended holiday, September 29th (Sunday) and October 12th (Saturday) will be working days.


Early Salary Payments for Some Employees


As the National Day holiday approaches, employees whose salary payday falls between October 1st and 7th should take note—you may receive your salary early!


According to Article 7 of the Interim Provisions on Wage Payment, wages must be paid on the agreed-upon date between the employer and employee. If the payday falls on a holiday or rest day, wages should be paid on the last working day before the holiday. Wages must be paid at least once a month, although weekly, daily, or hourly wage systems are also permissible.


Many companies issue salaries by the 5th of each month, which means that for the National Day holiday, some companies may choose to pay salaries at the end of September.


How Is Overtime Pay Calculated?


Per Article 13 of the Interim Provisions on Wage Payment:


1. If an employer requires an employee to work beyond the standard working hours, they must pay at least 150% of the employee's hourly wage as stipulated in the labor contract.


2. If an employee is required to work on rest days without being given compensatory time off, the employer must pay at least 200% of the employee's daily or hourly wage.


3. If work is required on statutory holidays, the employer must pay at least 300% of the employee's daily or hourly wage.


For workers on a piece-rate basis, if they are asked to work overtime after completing their quota, they should be paid according to the above rates: 150%, 200%, or 300%, depending on the situation.


Overtime Pay Cannot Be Replaced with Goods or Holiday Bonuses


Article 5 of the Interim Provisions on Wage Payment stipulates that wages must be paid in legal currency and cannot be replaced by physical goods or securities.


Overtime pay is compensation for the loss of rest and holiday time, constituting a form of statutory wage remuneration that employers are legally obligated to provide. Therefore, when employees work overtime, the employer must either provide compensatory time off or pay overtime wages in currency, not substitute it with goods or holiday bonuses.
