Random Inspection on Foreign Work Permits

July 19, 2024: The Department of Science and Technology of Shandong Province, in partnership with the Provincial Human Resources and Social Security Department and the Provincial Public Security Department, has initiated a comprehensive inspection of Class A and Class B work permits for foreign nationals in order to standardise the employment of foreign nationals in China. The inspection will continue until July 2024.

Overview of the Inspection

The inspection will concentrate on six entities that have processed work permits for foreign nationals. We will randomly select these entities from the central and provincial units in Jinan. The selection process employs the province's joint "Double Random, One Open" regulatory platform.

Department of Science and Technology

Inspection Item: Foreign nationals' adherence to Class A and Class B work permits.

Content:

We validate the employment authorizations of foreign nationals.

We are ensuring that foreign nationals are operating within the parameters established by their work permits.

The Department of Human Resources and Social Security is involved

Inspection Item: Employers' adherence to labor regulations.

Content:

We are verifying whether foreign nationals have declined to submit their employment certificates.

We are monitoring the unauthorised changes of employers, positions, or extensions of employment periods by foreign nationals.

Foreign nationals and employers are examining the potential forgery, alteration, misuse, transfer, or sale of employment certificates and permits.

We ensure that employers have the necessary permits to hire foreign nationals and that they don't hire foreign nationals without valid employment certificates.

Public Security Department

Inspection Item: Assessment of foreign nationals' compliance with work permits.

Content:

Foreign nationals' passports or other international travel documents are examined.

We verify the stay and residence permits of foreign nationals.

Legal Foundation

The Exit and Entry Administration Law and the Administrative Licensing Law of the People's Republic of China guide the conduct of the examinations.

Method of Inspection

A team of six law enforcement officers, including two representatives from the Provincial Department of Science and Technology, the Provincial Human Resources and Social Security Department, and the Provincial Public Security Department, will conduct the investigation. These teams will conduct "Double Random, One Open" spot inspections to ensure fairness and transparency.

The collaborative initiative emphasizes the province's commitment to preserving a regulated and legal environment for foreign professionals employed in China.
