Province to Launch Random Inspection on Foreign Work Permits!
July 19, 2024 - In an effort to standardize the employment of foreign nationals in China, Department of Science & Technology of Shandong Province, in collaboration with the Provincial Human Resources and Social Security Department and the Provincial Public Security Department, has launched a comprehensive inspection of Class A and Class B work permits for foreigners. The inspection is scheduled to take place throughout July 2024.
Inspection Overview
The inspection will focus on six entities, randomly selected from central and provincial units based in Jinan, that have processed work permits for foreign nationals. The selection process uses the province's joint "Double Random, One Open" regulatory platform.
Inspection Details
Department of Science & Technology
Inspection Item: Compliance with Class A and Class B work permits for foreigners.
Content:
Verification of the possession of valid work permits for foreigners.
Ensuring that foreign nationals are working within the limits specified by their work permits.
Human Resources and Social Security Department
Inspection Item: Adherence to labor regulations by employers.
Content:
Checking for any refusal by foreign nationals to present employment certificates.
Monitoring unauthorized changes of employers, jobs, or extensions of employment periods by foreign nationals.
Investigating potential forgery, alteration, misuse, transfer, or sale of employment certificates and permits by foreign nationals and employers.
Ensuring that foreign nationals are not employed without valid employment certificates and that employers have the necessary permits to hire foreign nationals.
Public Security Department
Inspection Item: Verification of compliance with work permits for foreigners.
Content:
Inspection of passports or other international travel documents held by foreign nationals.
Verification of stay and residence permits for foreign nationals.
Legal Basis
The inspections are conducted under the legal framework provided by the Exit and Entry Administration Law of the People's Republic of China and the Administrative Licensing Law of the People's Republic of China.
Inspection Method
The inspection will involve a team of six law enforcement officers, with two representatives each from the Provincial Department of Science and Technology, the Provincial Human Resources and Social Security Department, and the Provincial Public Security Department. These teams will conduct the "Double Random, One Open" spot checks to ensure transparency and fairness.
The joint initiative underscores the province's commitment to maintaining a regulated and lawful environment for foreign professionals working in China.
