Seven Foreigners Denied Entry at Border for Suspected Visa Violations
Yunnan, June 15 - During a routine inspection at the Hekou (Highway) Port of Entry, the Hekou Border Checkpoint of the Yunnan Border Inspection Station detained seven foreign nationals for having visas that did not match their stated purposes of entry.
The seven individuals, each holding a regular foreign passport and a single-entry 15-day Chinese tourist visa, claimed they were part of a border tourism group. However, discrepancies arose when the tour guide clarified that these travelers were not members of the tour group, prompting further investigation by immigration officers.
Upon detailed questioning, it was revealed that the seven individuals intended to travel to Kunming after entering China. None could provide specific details about their travel itinerary. Additionally, they were found carrying no cash, and their mobile phones contained group chats with photos of documents and visas, all arranged by a foreign national in the group. Further scrutiny indicated that two of the individuals were suspected of attempting to seek illegal employment in China.
Based on these findings, the Hekou Border Checkpoint, adhering to Articles 25 and 67 of the Exit and Entry Administration Law of the People's Republic of China, denied entry to the seven travelers and canceled their visas. Other involved parties have been reported to relevant authorities for further investigation.
Legal Background
According to Article 25 of the Exit and Entry Administration Law, foreign nationals are not permitted entry if they:
1. Do not hold valid exit and entry documents or refuse to undergo border inspection;
2. Fall under circumstances specified in Article 21, clauses 1 to 4;
3. Are likely to engage in activities inconsistent with their visa type after entry;
4. Are prohibited from entry under other laws and administrative regulations.
For those denied entry, border inspection authorities are not required to provide a reason.
Article 67 states that if a visa or residence permit is damaged, lost, stolen, or issued to an ineligible person, the issuing authority may declare it void. Forged, altered, or fraudulently obtained documents are also invalid, and public security organs may annul or confiscate these documents.
Article 80 stipulates that foreign nationals illegally employed are subject to fines ranging from RMB 5,000 to RMB 20,000, with severe cases resulting in detention and additional fines. Facilitators and employers of illegal employment also face significant fines and penalties.
